Luigi Mangione case: Defense likely to enter insanity plea, says expert

Luigi Mangione, the suspect in the killing of UnitedHealth CEO Brian Thompson, waived extradition and arrived in New York on Thursday. 

New York-based criminal defense attorney Mario Gallucci joined FOX 5's LiveZone to discuss the latest updates on Mangione's case. 

Mangione is facing 11 counts in New York along with a federal indictment in the Southern District. 

"I am sure that one of the first things they're going to do is ask for a mental fitness test to see if he's actually even fit to proceed, and if he is found fit to proceed, I'm sure that you're going to hear what we call in N.G.R.I defense, which is not guilty by reason of insanity," said Galucci.

Gallucci also comments on some of the online chatter around a possible jury nullification, which is when the jury disregards the evidence against a defendant and chooses to find them not guilty.

"I don't know of any defense attorney that goes into a trial thinking, all right, my defense is jury nullification." says Gallucci.
