Back in November, FOX 5 was the first to expose the issues with the Rodgers Brothers solid waste facility in the Northeast D.C. residential neighborhood of Langdon Park.

Neighbors and local activists demanded the city and its elected officials to do something about the exorbitant amount of dust and foul smell produced by the site.

The company signed a settlement agreement with the city back in 2012 where its owners agreed to comply with basic tenets.

As a result of FOX 5's investigation, the District has found Rodgers Brothers "in non-compliance" with the agreement and has ordered the site to comply and remedy the issues by Feb. 10 or face action from D.C.'s Office of the Attorney General.
